These Terms of Service ("Terms") govern your access to and use of the ZentroDial mobile application and related services (collectively, the "Service") provided by ZentroDial ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By accessing or using ZentroDial, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
ZentroDial is a power dialer application for iPhone designed for sales professionals. The Service allows you to upload lead lists, initiate phone calls using your device's native dialer, log call dispositions, schedule callbacks, and track calling statistics. ZentroDial does not provide VoIP or telephony services — all calls are placed through your device's native phone app using your own carrier and phone number.
To use ZentroDial, you must create an account by providing a valid email address and other requested information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access to your account.
You agree to provide accurate and complete information when creating your account and to keep your account information up to date.
Free Trial. New users may be eligible for a 7-day free trial. During the trial period, you have full access to the Service. If you do not subscribe before the trial ends, your access to premium features will be suspended.
Subscription Plans. ZentroDial offers two subscription plans:
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable subscription fee at the beginning of each renewal period.
Payment Processing. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on file for the applicable subscription fees. You are responsible for keeping your payment information current.
Cancellation. You may cancel your subscription at any time through the app or by contacting us at support@zentrodial.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period you have already paid for. We do not provide prorated refunds for partial billing periods.
Price Changes. We reserve the right to change subscription prices. If we change pricing, we will provide at least 30 days' notice before the new price takes effect. Your continued use of the Service after a price change constitutes acceptance of the new price.
You agree to use ZentroDial responsibly and in compliance with all applicable laws. Specifically, you agree to the following:
The ZentroDial name, logo, application, website, and all related content, features, and functionality are owned by ZentroDial and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.
You retain ownership of the lead data and content you upload to ZentroDial. By uploading data, you grant us a limited license to store, process, and display that data solely for the purpose of providing the Service to you.
To the maximum extent permitted by law, ZentroDial and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you have paid us in subscription fees during the twelve (12) months preceding the claim.
ZentroDial is not responsible for any consequences arising from your calling activities, including but not limited to violations of telemarketing laws, complaints from call recipients, or actions taken by regulatory authorities.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that any data you upload will be preserved indefinitely. We do not guarantee any specific results from using the Service.
ZentroDial relies on your device's native phone functionality and your cellular carrier to place calls. We are not responsible for call quality, dropped calls, carrier charges, or any issues related to your phone service.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms or are using the Service in a manner that could harm ZentroDial, other users, or third parties.
You may terminate your account at any time by contacting us at support@zentrodial.com. Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
